Washington State Trespassing Laws
Trespassing is classified into two degrees under Washington law chapter 9A.52. First-degree trespassing is charged as a gross misdemeanor and involves a person intentionally, unlawfully, entering or remaining in a building. Second-degree trespassing is charged as a misdemeanor and involves a person intentionally, unlawfully, entering or remaining on the premises of another.
The penalties for criminal trespassing include:
First degree
- Up to 1-year in jail
- $5,000 fine
Second degree
- Up to 90-days in jail
- $1,000 fine
Defenses for Criminal Trespassing Charges
The four defenses provided for trespassing charges exist if:
- The building was abandoned.
- The premises were open to the public, and you complied with all the rules and conditions of lawfully being on the premises.
- You thought that the owner would have given you permission to be on the premises.
- You were on the premises to serve legal papers.

Trespassing charges may be “compromised.”
Washington provides a rule known as the misdemeanor compromise statute. As long as you are not a law enforcement officer, you were not rioting, you did not attempt to commit a felony, and the trespassing didn’t involve domestic violence, criminal trespassing charges may be dropped.
